These Terms of Use govern your access to and use of Gumeo, including the Gumeo mobile app and website.
By using Gumeo, you agree to these Terms. If you do not agree, do not use Gumeo.
1. What Gumeo Is
Gumeo is a guitar learning and practice app. It helps users build practice routines, track progress, use focus tools, and access premium practice features through subscriptions.
Gumeo is a practice support tool. It does not guarantee that you will improve at guitar, reach a specific skill level, or achieve any particular result.
2. Eligibility
You must be old enough to use Gumeo under the laws of your country or region.
If you use Gumeo on behalf of another person or allow a minor to use Gumeo, you are responsible for ensuring that use complies with these Terms and applicable law.
3. Accounts
You may need to sign in to use Gumeo. Gumeo currently supports Sign in with Apple and Google Sign-In.
You are responsible for maintaining the security of your Apple ID, Google account, device, and Gumeo account.
You agree not to:
- use another person's account without permission;
- provide false or misleading account information;
- interfere with Gumeo's authentication, subscription, or access systems;
- attempt to bypass premium access controls.
4. Premium Access and Subscriptions
Gumeo is free to download, but access to the main app or premium features may require an auto-renewable subscription.
Gumeo Premium may include features such as personalized practice plans, progress tracking, practice tools, Lock-In Mode, chord library access, or other premium features shown in the app.
Subscriptions are purchased through Apple's In-App Purchase system and are subject to Apple's payment terms.
Available subscription products may include:
- Gumeo Premium Weekly;
- Gumeo Premium Yearly;
- Gumeo Premium Special Offer Yearly.
The exact price, duration, renewal terms, and availability are shown in the App Store purchase sheet before you confirm purchase.
5. Billing and Renewal
Subscriptions automatically renew unless canceled according to Apple's subscription rules.
Your Apple ID account will be charged through Apple. Gumeo does not directly process your payment card information.
You can manage or cancel your subscription through Apple subscription settings.
Deleting your Gumeo account, uninstalling the app, or stopping use of Gumeo does not automatically cancel your Apple subscription renewal.
6. Restore Purchases
Gumeo provides a Restore Purchases option through the paywall or settings.
Restore Purchases asks Apple and RevenueCat to re-check your existing purchases and recover premium access if you have an active subscription.
Restore Purchases does not create a new purchase.
7. Refunds
Refunds, billing issues, and subscription cancellations are handled by Apple according to Apple's App Store policies.
Gumeo cannot directly issue App Store subscription refunds unless Apple provides a supported process for doing so.
8. Account Deletion
You can request deletion of your Gumeo account from within the app, usually through Profile or Settings.
Account deletion removes or disables access to your Gumeo account and associated Gumeo data, subject to technical, legal, fraud prevention, tax, accounting, and compliance requirements.
Account deletion does not cancel your Apple subscription renewal. You must manage or cancel subscriptions through Apple subscription settings.
Some transaction, purchase, or subscription records may remain with Apple, RevenueCat, or related service providers as required for transaction records, fraud prevention, legal compliance, tax, accounting, or security purposes.
9. Practice and Safety
Gumeo provides guitar learning and practice guidance, but it is not a substitute for professional instruction, medical advice, or physical therapy.
You are responsible for practicing safely. Stop practicing and seek appropriate advice if you experience pain, injury, discomfort, or other health concerns.
Gumeo does not guarantee musical improvement, skill development, or any specific outcome.
10. Lock-In Mode and Focus Features
Gumeo may include focus tools such as Lock-In Mode, using Apple's Screen Time, Family Controls, DeviceActivity, ManagedSettings, or related APIs.
These features are intended to help you reduce distractions during practice. You are responsible for configuring them appropriately.
Gumeo does not guarantee uninterrupted focus, complete blocking of all distractions, or compatibility with every device setting or app.
11. Notifications
Gumeo may offer optional local notifications such as practice reminders, streak reminders, comeback reminders, or paywall-related reminders.
You can control notifications through Gumeo settings and iOS notification settings.
Gumeo is not responsible if you do not receive a notification, receive it late, dismiss it, or disable notification permissions.
12. Acceptable Use
You agree not to:
- misuse Gumeo;
- interfere with Gumeo's systems or security;
- reverse engineer, decompile, or attempt to extract source code except where permitted by law;
- bypass subscription or entitlement checks;
- use Gumeo to violate laws or third-party rights;
- abuse support, account deletion, or restore purchase systems;
- upload or submit harmful, illegal, or infringing content, if Gumeo offers any user-submitted content features.
13. Intellectual Property
Gumeo, including its app design, branding, mascot, text, graphics, logos, software, and other content, is owned by us or our licensors.
You may use Gumeo only as permitted by these Terms and applicable App Store terms.
You may not copy, modify, distribute, sell, rent, sublicense, or create derivative works based on Gumeo except as allowed by law or with our permission.
14. User Data and Content
You retain any rights you have in information you provide to Gumeo.
You grant us permission to process your account, profile, onboarding, practice, and progress data as needed to provide, maintain, personalize, and improve Gumeo.
You are responsible for the accuracy of information you provide.
15. Third-Party Services
Gumeo relies on third-party services, including Apple, Google, Supabase, RevenueCat, and website hosting providers.
Your use of those services may be subject to their own terms and privacy policies.
We are not responsible for third-party services that we do not control.
16. Apple App Store Terms
Your download and use of Gumeo through the App Store may also be governed by Apple's applicable App Store terms, including Apple's Standard End User License Agreement unless a custom license agreement applies.
If there is a conflict between these Terms and mandatory Apple terms, Apple's applicable terms may control for App Store distribution matters.
17. Changes to Gumeo
We may modify, suspend, or discontinue parts of Gumeo at any time.
We may add, remove, or change features, subscription offerings, practice content, routines, tools, or availability.
We will try to avoid disrupting active subscribers unfairly, but we do not guarantee that every feature will remain available forever.
18. Service Availability
Gumeo may not always be available, error-free, or uninterrupted.
Access may be affected by maintenance, Apple services, Google authentication, Supabase, RevenueCat, network issues, device settings, or other factors outside our control.
19. Termination
We may suspend or terminate your access to Gumeo if you violate these Terms, misuse the app, create risk, infringe rights, or use Gumeo unlawfully.
You may stop using Gumeo at any time. If you have an active Apple subscription, you are responsible for canceling it through Apple subscription settings.
20. Disclaimers
Gumeo is provided "as is" and "as available."
To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and error-free operation.
Gumeo does not guarantee specific learning outcomes, practice consistency, skill improvement, or musical results.
21. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity.
To the fullest extent permitted by law, our total liability for claims related to Gumeo will not exceed the amount you paid for Gumeo in the twelve months before the claim.
Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
22. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold us harmless from claims, losses, liabilities, damages, costs, or expenses arising from your misuse of Gumeo, violation of these Terms, or violation of law or third-party rights.
23. Changes to These Terms
We may update these Terms from time to time.
If changes are material, we may notify you through the app, website, or other appropriate means.
